General Terms and Conditions of Rib\u00f3 Hermanos Ingenier\u00eda en Sistemas de Comercio S.A. de C.V. (Rhiscom M\u00e9xico)<\/span><\/h1>\n

RIBO HERMANOS INGENIER\u00cdA EN SISTEMAS DE COMERCIO S.A. de C.V., also known as RHISCOM M\u00c9XICO, invites you to carefully read our Terms and Conditions (hereinafter referred to as the \u201cCONDITIONS\u201d). This adhesion contract is fully binding between you, as the \u201cUSER,\u201d and RIBO HERMANOS INGENIER\u00cdA EN SISTEMAS DE COMERCIO S.A. de C.V., hereinafter referred to as \u201cRHISCOM M\u00c9XICO,\u201d and together referred to as \u201cTHE PARTIES.\u201d Therefore, any person who wishes to access or make use of the services and\/or products available through the website https:\/\/rhiscom.com (hereinafter referred to as \u201cTHE SITE\u201d) and\/or its social media complements<\/p>\n

    Which, jointly or separately, are referred to in this contract as \u201cNETWORKS,\u201d may do so subject to our privacy notices and this contract.
    \nThese \u201cCONDITIONS\u201d govern the general use of any service offered by \u201cRHISCOM M\u00c9XICO,\u201d including the services you contract, except when we expressly indicate that other Terms and Conditions (and not these) apply. Please note that these \u201cCONDITIONS\u201d are subject to change without prior notice, and we recommend staying informed through \u201cTHE SITE.\u201d<\/p>\n

    Use of \u201cTHE SITE\u201d:<\/h2>\n

    \u201cRHISCOM M\u00c9XICO\u201d informs you that no person who is disqualified or legally prohibited from entering into this type of contract under the laws of the United Mexican States or the laws of their country of origin or residence, or any person acting as a legal representative or attorney-in-fact of a legal entity without sufficient authority to bind their principal, may contract our services.<\/p>\n

    At the time you contract with us, you declare, under oath, that you are of legal age, meaning at least 18 years old in accordance with Mexican law, or of legal age in your country of origin, and that you have full legal capacity and authority to enter into and be bound by the terms of this contract.<\/p>\n

    In the event that you act as a representative, attorney-in-fact, and\/or administrator, you declare under oath that you possess the necessary powers to acquire obligations and rights on behalf of and for a legal entity and\/or your principal, as well as to bind such entity to the provisions of this instrument and any other binding contracts that may arise from the products and\/or services requested.<\/p>\n

    The \u201cUSER\u201d agrees to assume full responsibility for the use of \u201cTHE SITE,\u201d including any risks related to quality, performance, service interruptions, data loss, or damages resulting from the misuse of services or third-party software, in which case the \u201cUSER\u201d shall bear any costs or expenses arising therefrom.<\/p>\n

    Accordingly, \u201cRHISCOM M\u00c9XICO\u201d disclaims all liability and provides no guarantees regarding the information contained or available, including, but not limited to, the availability of access to \u201cTHE SITE\u201d; absence of viruses, errors, deactivators, or any other contaminating or destructive material such as malware; or any potential failures of \u201cTHE SITE.\u201d<\/p>\n

    Any user and\/or client and\/or service provider and\/or partner engaging in illegal acts or acts contrary to morality and good customs shall be liable to \u201cRHISCOM M\u00c9XICO\u201d for any damages caused, and shall indemnify and hold \u201cRHISCOM M\u00c9XICO\u201d harmless from any claims, demands, lawsuits, fines, penalties, judgments, or awards issued by any authority against \u201cRHISCOM M\u00c9XICO.\u201d Likewise, we reserve the right to take any criminal, civil, commercial, intellectual property, or other actions deemed necessary to safeguard our rights.
    \nYou assume the consequences of using and\/or browsing \u201cTHE SITE,\u201d and we suggest taking the measures you consider appropriate to ensure the best possible experience.<\/p>\n

    Compatibility of \u201cTHE SITE\u201d:<\/h2>\n

    Privacy and Personal Data.<\/h2>\n

    We inform you that \u201cRHISCOM M\u00c9XICO\u201d is responsible for the processing of your personal data, as stated in our Privacy Notice.<\/p>\n

    However, once you have access to the personal data of any member of our team, including our professional service providers, you also become responsible for processing such data and must comply with the same obligations as \u201cRHISCOM M\u00c9XICO,\u201d in accordance with the New Law on the Protection of Personal Data Held by Private Parties and its regulations.<\/p>\n

    At \u201cRHISCOM M\u00c9XICO,\u201d all personal data collected from you are protected and processed in accordance with the highest privacy standards, aligned with Articles 6 and 14, second paragraph, of the Political Constitution of the United Mexican States, and in accordance with the general guidelines set out in Articles 7, 8, 9, 10, 14, 15, 16, 17, 32, 35, and 36 of the New Federal Law on the Protection of Personal Data Held by Private Parties (NLFPDPPP), as well as Articles 14, 24, 26, 27, 28, 30, 40, 41, 68, 90, and 102 of the Regulations of the Federal Law on the Protection of Personal Data Held by Private Parties (RLFPDPPP) and other applicable legislation.<\/p>\n

    Intellectual Property of \u201cTHE SITE\u201d<\/h2>\n

    The \u201cUSER\u201d acknowledges that the content of \u201cTHE SITE\u201d constitutes Intellectual Property Rights, including, but not limited to, all distinctive signs, trademarks, trade names, and service marks registered and\/or used by \u201cRHISCOM M\u00c9XICO,\u201d as well as domain names, reserved rights, copyrighted works, and other forms protected by intellectual and industrial property laws and applicable international treaties.<\/p>\n

    The reproduction, modification, publication, distribution, transmission, display, or performance of the content of \u201cTHE SITE\u201d without the prior written authorization of \u201cRHISCOM M\u00c9XICO\u201d or the corresponding rights holder is strictly prohibited. The User acknowledges that the use of the Services on \u201cTHE SITE\u201d shall not, under any circumstances, constitute implicit or explicit authorization or license to use the intellectual property thereof or any of its elements or contents.<\/p>\n

    All distinctive signs (trademarks, trade names, and service marks) appearing on \u201cTHE SITE\u201d that are not owned by \u201cRHISCOM M\u00c9XICO\u201d are the trademarks of their respective owners. Any reference made to third-party names, trademarks, products, or services does not constitute or imply any promotion or recommendation of such third parties or their products or services.<\/p>\n

    We inform the \u201cUSER\u201d that all services and\/or products offered through \u201cTHE SITE\u201d or the \u201cNETWORKS\u201d are for informational and promotional purposes only. Any purchase or contract must be made directly with an authorized sales representative of \u201cRHISCOM M\u00c9XICO.\u201d<\/p>\n

    Similarly, we inform you that all our services and\/or products are subject to change without prior notice. For specific terms and conditions of each, you must review them at the time of contracting or request them from an authorized and properly identified commercial representative of \u201cRHISCOM M\u00c9XICO.\u201d<\/p>\n

    Purchases or contracts:<\/h2>\n

    \u201cRHISCOM M\u00c9XICO\u201d is not responsible for any purchase or transfer of financial resources, intangibles, or information made through \u201cTHE SITE\u201d and\/or \u201cNETWORKS,\u201d as we hereby inform you that \u201cRHISCOM M\u00c9XICO\u201d does not use such channels to complete commercial transactions or contracts.<\/p>\n

    Warranty:<\/h2>\n

    Due to the nature of the services and\/or products offered by \u201cRHISCOM M\u00c9XICO,\u201d each warranty, return, or claim process related to service or product functionality will be specified in the individual service contracts executed for the corresponding project. For each service and\/or product, you should contact the authorized and properly identified sales representative of \u201cRHISCOM M\u00c9XICO\u201d to obtain this information, as well as details on delivery times for the product and\/or service contracted.<\/p>\n

    Intranet portal accessible through \u201cTHE SITE\u201d<\/h2>\n

    Access to and use of the \u201cRHISCOM M\u00c9XICO\u201d intranet portal is restricted exclusively to authorized and registered personnel. The purpose of this platform is to facilitate internal communication, access to confidential information, and the management of internal company resources.<\/p>\n

    The \u201cUSER\u201d agrees to maintain the confidentiality of their login information and not share credentials with third parties. The user also agrees to use the portal solely for work-related purposes and in accordance with the company\u2019s internal policies.<\/p>\n

    Any unauthorized, improper, or insecure use that jeopardizes information security may result in administrative or legal sanctions, including suspension or termination of access. The company reserves the right to monitor, record, and audit all activities conducted on the platform to ensure data protection and system integrity.<\/p>\n

    Finally, use of the portal implies acceptance that all information and data contained therein are confidential and may even constitute \u201cTRADE SECRETS,\u201d and must be handled with the highest level of responsibility and professional ethics. The company is not responsible for any damage or loss arising from misuse or unauthorized access to the portal.<\/p>\n

    Modifications to these CONDITIONS;<\/h2>\n

    \u201cTHE SITE\u201d reserves the right to modify the CONDITIONS contained in this contract, with such modifications becoming effective immediately upon:
    \nPublication on the website \u201cTHE SITE\u201d: https:\/\/rhiscom.com. Likewise, \u201cTHE SITE\u201d reserves the right to make additions to these CONDITIONS, which may be made to provide better service to you as the \u201cUSER\u201d and\/or client.<\/p>\n

    These changes shall take effect immediately upon publication and will always be available to you. Therefore, it is your responsibility to periodically review our website to stay informed of such modifications. Notwithstanding the foregoing, each time you, as the \u201cUSER,\u201d access the site, it shall be deemed as full acceptance of the aforementioned modifications and\/or additions.<\/p>\n

    Headings<\/h2>\n

    The clause headings in these \u201cCONDITIONS\u201d are included solely for the convenience of \u201cTHE PARTIES\u201d and shall have no effect on the literal or legal interpretation thereof.<\/p>\n

    Severability<\/strong><\/p>\n

    If any clause of this instrument is declared null or invalid, such clause shall be considered independent and separable from the rest, which shall remain in full force and effect within these \u201cCONDITIONS.\u201d<\/p>\n

    Waivers<\/strong><\/p>\n

    Failure or omission, in whole or in part, by either of \u201cTHE PARTIES\u201d to exercise the rights arising from this Contract or any modification thereof shall not constitute a waiver of such rights for future exercise.<\/p>\n

    \u201cTHE PARTIES\u201d agree to waive collective actions; therefore, each party may bring legal proceedings or dispute resolution mechanisms solely and exclusively on an individual basis.<\/p>\n

    Jurisdiction<\/h2>\n

    For the interpretation and enforcement of this contract, the parties expressly submit to the jurisdiction and competence of the courts of Mexico City, Mexico, expressly waiving any other jurisdiction that may correspond to them due to present or future domicile. However, \u201cTHE PARTIES\u201d agree to first submit to Alternative Dispute Resolution mechanisms in accordance with the applicable law and before duly accredited institutions.<\/p>\n
