General Terms and Conditions of Ribó Hermanos Ingeniería en Sistemas de Comercio S.A. de C.V. (Rhiscom México)

RIBO HERMANOS INGENIERÍA EN SISTEMAS DE COMERCIO S.A. de C.V., also known as RHISCOM MÉXICO, invites you to carefully read our Terms and Conditions (hereinafter referred to as the “CONDITIONS”). This adhesion contract is fully binding between you, as the “USER,” and RIBO HERMANOS INGENIERÍA EN SISTEMAS DE COMERCIO S.A. de C.V., hereinafter referred to as “RHISCOM MÉXICO,” and together referred to as “THE PARTIES.” Therefore, any person who wishes to access or make use of the services and/or products available through the website https://rhiscom.com (hereinafter referred to as “THE SITE”) and/or its social media complements

Which, jointly or separately, are referred to in this contract as “NETWORKS,” may do so subject to our privacy notices and this contract.
These “CONDITIONS” govern the general use of any service offered by “RHISCOM MÉXICO,” including the services you contract, except when we expressly indicate that other Terms and Conditions (and not these) apply. Please note that these “CONDITIONS” are subject to change without prior notice, and we recommend staying informed through “THE SITE.”

Use of “THE SITE”:

“RHISCOM MÉXICO” informs you that no person who is disqualified or legally prohibited from entering into this type of contract under the laws of the United Mexican States or the laws of their country of origin or residence, or any person acting as a legal representative or attorney-in-fact of a legal entity without sufficient authority to bind their principal, may contract our services.

At the time you contract with us, you declare, under oath, that you are of legal age, meaning at least 18 years old in accordance with Mexican law, or of legal age in your country of origin, and that you have full legal capacity and authority to enter into and be bound by the terms of this contract.

In the event that you act as a representative, attorney-in-fact, and/or administrator, you declare under oath that you possess the necessary powers to acquire obligations and rights on behalf of and for a legal entity and/or your principal, as well as to bind such entity to the provisions of this instrument and any other binding contracts that may arise from the products and/or services requested.

The “USER” agrees to assume full responsibility for the use of “THE SITE,” including any risks related to quality, performance, service interruptions, data loss, or damages resulting from the misuse of services or third-party software, in which case the “USER” shall bear any costs or expenses arising therefrom.

Accordingly, “RHISCOM MÉXICO” disclaims all liability and provides no guarantees regarding the information contained or available, including, but not limited to, the availability of access to “THE SITE”; absence of viruses, errors, deactivators, or any other contaminating or destructive material such as malware; or any potential failures of “THE SITE.”

Any user and/or client and/or service provider and/or partner engaging in illegal acts or acts contrary to morality and good customs shall be liable to “RHISCOM MÉXICO” for any damages caused, and shall indemnify and hold “RHISCOM MÉXICO” harmless from any claims, demands, lawsuits, fines, penalties, judgments, or awards issued by any authority against “RHISCOM MÉXICO.” Likewise, we reserve the right to take any criminal, civil, commercial, intellectual property, or other actions deemed necessary to safeguard our rights.
You assume the consequences of using and/or browsing “THE SITE,” and we suggest taking the measures you consider appropriate to ensure the best possible experience.

Compatibility of “THE SITE”:

“THE SITE” is a web service compatible with Firefox® and Chrome® browsers under the following operating systems: Windows®, OSX®, IOS®. “THE SITE” is not responsible for any changes in the aforementioned systems that may, at some point, make it incompatible with “THE SITE.” Use of our services on servers other than those mentioned is at your own risk, and we are not responsible for any damages that may result.

Access to “THE SITE” requires a broadband Internet connection and a compatible browser. Please note that this may involve additional costs and expenses independent of the service provided by “THE SITE.”

Data that may be automatically collected:

The following data are collected through the use of server log files and tracking technologies, as detailed in the use of cookies.

System Data Technical information about the user’s equipment or device:

  • IP address;
  • Device type;
  • Operating system version;
  • Unique device identifier;
  • Browser;
  • Browser language.
Usage Data Usage statistics about the user’s interactions with the Services, content accessed, time spent on pages, features used, search queries, click data, date and time, and referrals.
Approximate Geographical Data An approximate geographical location such as country or city, based on the IP address.

Use of cookies and web beacons

Cookies are text files that are automatically downloaded and stored on the user’s hard drive when browsing a specific webpage, allowing the Internet server to remember certain user data, including preferences for viewing pages, username, and password.

“THE SITE” may contain links to other websites, resources, and third-party advertisers. However, “RHISCOM MÉXICO” does not control, endorse, sponsor, recommend, or assume any responsibility for these linked contents. Since we are not responsible for the availability of such external resources, nor for their content or privacy practices, you should address any concerns regarding linked content directly with those sites.

Privacy and Personal Data.

We inform you that “RHISCOM MÉXICO” is responsible for the processing of your personal data, as stated in our Privacy Notice.

However, once you have access to the personal data of any member of our team, including our professional service providers, you also become responsible for processing such data and must comply with the same obligations as “RHISCOM MÉXICO,” in accordance with the New Law on the Protection of Personal Data Held by Private Parties and its regulations.

At “RHISCOM MÉXICO,” all personal data collected from you are protected and processed in accordance with the highest privacy standards, aligned with Articles 6 and 14, second paragraph, of the Political Constitution of the United Mexican States, and in accordance with the general guidelines set out in Articles 7, 8, 9, 10, 14, 15, 16, 17, 32, 35, and 36 of the New Federal Law on the Protection of Personal Data Held by Private Parties (NLFPDPPP), as well as Articles 14, 24, 26, 27, 28, 30, 40, 41, 68, 90, and 102 of the Regulations of the Federal Law on the Protection of Personal Data Held by Private Parties (RLFPDPPP) and other applicable legislation.

Intellectual Property of “THE SITE”

The “USER” acknowledges that the content of “THE SITE” constitutes Intellectual Property Rights, including, but not limited to, all distinctive signs, trademarks, trade names, and service marks registered and/or used by “RHISCOM MÉXICO,” as well as domain names, reserved rights, copyrighted works, and other forms protected by intellectual and industrial property laws and applicable international treaties.

The reproduction, modification, publication, distribution, transmission, display, or performance of the content of “THE SITE” without the prior written authorization of “RHISCOM MÉXICO” or the corresponding rights holder is strictly prohibited. The User acknowledges that the use of the Services on “THE SITE” shall not, under any circumstances, constitute implicit or explicit authorization or license to use the intellectual property thereof or any of its elements or contents.

All distinctive signs (trademarks, trade names, and service marks) appearing on “THE SITE” that are not owned by “RHISCOM MÉXICO” are the trademarks of their respective owners. Any reference made to third-party names, trademarks, products, or services does not constitute or imply any promotion or recommendation of such third parties or their products or services.

Products or services offered through “THE SITE”

We inform the “USER” that all services and/or products offered through “THE SITE” or the “NETWORKS” are for informational and promotional purposes only. Any purchase or contract must be made directly with an authorized sales representative of “RHISCOM MÉXICO.”

Similarly, we inform you that all our services and/or products are subject to change without prior notice. For specific terms and conditions of each, you must review them at the time of contracting or request them from an authorized and properly identified commercial representative of “RHISCOM MÉXICO.”

Purchases or contracts:

“RHISCOM MÉXICO” is not responsible for any purchase or transfer of financial resources, intangibles, or information made through “THE SITE” and/or “NETWORKS,” as we hereby inform you that “RHISCOM MÉXICO” does not use such channels to complete commercial transactions or contracts.

Warranty:

Due to the nature of the services and/or products offered by “RHISCOM MÉXICO,” each warranty, return, or claim process related to service or product functionality will be specified in the individual service contracts executed for the corresponding project. For each service and/or product, you should contact the authorized and properly identified sales representative of “RHISCOM MÉXICO” to obtain this information, as well as details on delivery times for the product and/or service contracted.

Intranet portal accessible through “THE SITE”

Access to and use of the “RHISCOM MÉXICO” intranet portal is restricted exclusively to authorized and registered personnel. The purpose of this platform is to facilitate internal communication, access to confidential information, and the management of internal company resources.

The “USER” agrees to maintain the confidentiality of their login information and not share credentials with third parties. The user also agrees to use the portal solely for work-related purposes and in accordance with the company’s internal policies.

Any unauthorized, improper, or insecure use that jeopardizes information security may result in administrative or legal sanctions, including suspension or termination of access. The company reserves the right to monitor, record, and audit all activities conducted on the platform to ensure data protection and system integrity.

Finally, use of the portal implies acceptance that all information and data contained therein are confidential and may even constitute “TRADE SECRETS,” and must be handled with the highest level of responsibility and professional ethics. The company is not responsible for any damage or loss arising from misuse or unauthorized access to the portal.

Modifications to these CONDITIONS;

“THE SITE” reserves the right to modify the CONDITIONS contained in this contract, with such modifications becoming effective immediately upon:
Publication on the website “THE SITE”: https://rhiscom.com. Likewise, “THE SITE” reserves the right to make additions to these CONDITIONS, which may be made to provide better service to you as the “USER” and/or client.

These changes shall take effect immediately upon publication and will always be available to you. Therefore, it is your responsibility to periodically review our website to stay informed of such modifications. Notwithstanding the foregoing, each time you, as the “USER,” access the site, it shall be deemed as full acceptance of the aforementioned modifications and/or additions.

Headings

The clause headings in these “CONDITIONS” are included solely for the convenience of “THE PARTIES” and shall have no effect on the literal or legal interpretation thereof.

Severability

If any clause of this instrument is declared null or invalid, such clause shall be considered independent and separable from the rest, which shall remain in full force and effect within these “CONDITIONS.”

Waivers

Failure or omission, in whole or in part, by either of “THE PARTIES” to exercise the rights arising from this Contract or any modification thereof shall not constitute a waiver of such rights for future exercise.

“THE PARTIES” agree to waive collective actions; therefore, each party may bring legal proceedings or dispute resolution mechanisms solely and exclusively on an individual basis.

Jurisdiction

For the interpretation and enforcement of this contract, the parties expressly submit to the jurisdiction and competence of the courts of Mexico City, Mexico, expressly waiving any other jurisdiction that may correspond to them due to present or future domicile. However, “THE PARTIES” agree to first submit to Alternative Dispute Resolution mechanisms in accordance with the applicable law and before duly accredited institutions.
